Need help with legal issue?

Okay so here the deal. I had a guy stay with me and he went to the city when he came back one of our schools had been robbed but he was in the city he brought me a few computers to fix for him and I put in a anti virus disc into one of them, Didn’t touch any of the others. He came back 20 minutes later and took them all back to the city. The next thing I know is Me and him get into an argument he breaks the door to my bathroom, and I call the cops. He says he broke into the school and stole some stuff up there. Now i get charged with computer tampering in the third degree and posseion of stolen property in the 4th 2 felonys. I go to court and the laywer I had makes me sign a pre plea bargain for 3 years probation, court costs and restitution, this guy come to find out is an illeagal alien, now He does 4 1/2 months in jail and gets sent to ice detainee area in albany NY they release him and say his charges are no severe enough. Now he is walking around with a criminal record prior to this and no restitution no court costs. For me this is a first time offence, they never found anything in my posseion, I told the cops the truth they searched my house and property with out a search warrant because I allowed them to I have nothing to find but now this guy is walking around is this legal what can I do?

The only thing you can do is learn from the experience and serve the probation you agreed to and pay the restitution if you have been sentenced if not change your plea to not guilty and they will probably not be able to find him for his testimony. They may dismiss the charges and you can avoid a criminal record.}{
